Terms of Use

1 These terms

 

 1.1 These are the terms and conditions on which we supply Social Media Templates (“Products”) to you through our website, software and applications provided by us (collectively, our “Platform”).

 

1.2 Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide Products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or require any changes, please contact us to discuss.

 

1.3 By using our Platform, you agree to these terms. If you are using our Platform as a representative of an entity, you are agreeing to these terms on behalf of that entity.

 

2 Information about us and how to contact us

 

2.1 We are Roar Social Limited, a company registered in Hong Kong, trading as Posty. Our company registration number is 66533695.

 

2.2 For any questions or problems relating to our Platform, our Products or these terms, you can contact us by emailing us at support@posty.com.hk.

 

2.3 If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us.

 

2.4 When we use the words "writing" or "written" in these terms, this includes emails.

 

3 Our contract with you

 

3.1 You may place orders with us as instructed on our Platform. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

 

3.2 If we are unable to accept your order, we will let you know in writing and will not charge you for the Product ordered. This might be because:

 

(a) the Product ordered is out of stock;

 

(b) there are unexpected limits on our resources which we could not reasonably plan for;

 

(c) we have identified an error in the price or description of the Product; or

 

(d) we are unable to meet a delivery deadline you have specified.

 

3.3 We will assign an order number to each order. Please tell us the order number whenever you contact us about your order.

 

3.4 Our Platform is solely for the promotion of our Products in Hong Kong.

 

4 Your rights to make changes

 

If you wish to make a change to the Product you have ordered, please contact us. We have full discretion whether or not to accept the changes. We will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract (see Clause Your rights to end the - Your rights to end the contract).

 

5 Changes to our product or these terms

 

5.1 We may make minor changes to the Product from time to time in order to:

 

(a) reflect changes in relevant laws and regulatory requirements; and

 

(b) implement minor technical adjustments and improvements, for example to address a security threat. These changes will not affect your use of the product.

 

5.2 If we make significant changes to these terms or the Product, we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any Products paid for but not received.

 

6. Third-Party Websites

 

You may be able to link from the Application to third-party websites that take you outside of the Application (“Linked Sites”). We have no responsibility for the information, content, products, services, advertising, code or other material, which may be provided through the Linked Sites, so please use common sense as you navigate the Web and be aware when you leave the Application.

 

7. User Submissions

 

Subject to this Agreement and the functionality of the Platform, you may comment on content, contribute to forums, and otherwise submit content (together, “User Submissions“) through the Platform. Any User Submissions that you submit to Posty in connection with a contest, sweepstakes, or other promotion (“Promotion“) will be subject to this Agreement unless the applicable terms, conditions, and/or official rules that govern the Promotion expressly state the contrary. You own all intellectual property rights in and to your User Submissions. By posting or uploading User Submissions through the Platform, you grant Posty a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub- licensable (through multiple tiers), and transferable license to use, reproduce, distribute, prepare derivative works of, decompile, reverse engineer, data process, display, perform, and otherwise exercise all rights in and to the User Submissions in connection with Posty’s business, including, without limitation, through the Platform, for marketing and advertising purposes, and on Posty merchandise in any media formats and through any media channels now known or hereinafter invented. Without limiting the foregoing, the license may also be exercised by third parties acting on Posty’s behalf. You also grant each user of the Platform a non-exclusive license to access your User Submissions through the Platform.
